Mandatory legal information about Golova Europe SL, the Spanish company that operates Puntavia, published under Article 10 of the Spanish LSSI-CE.

2. Purpose and scope

This Legal Notice provides the mandatory legal information about the operator of the website https://puntavia.com and governs access to and use of the website, the control panel and the Puntavia desktop program (together, the "Services").

Access to the Services confers the status of "User" and implies full acceptance of the provisions of this Legal Notice in the version published at the time of access, as well as of the Privacy Policy and the Cookie Policy published on the same website.

Where a company subscribes to Puntavia in order to record the working time of its employees, the contractual relationship between that company and Golova Europe SL is additionally governed by the terms of service accepted on subscription. This Legal Notice does not replace them.

3. Activity

Golova Europe SL operates Puntavia, a Software-as-a-Service (SaaS) platform that automatically records working time for small companies in the European Union. The activity does not require prior administrative authorisation under Spanish or EU legislation applicable to the SaaS sector.

The product works as follows: a desktop program (Windows, macOS and Linux), installed by the employer on work computers, records for each interval the name of the active application, the title of its window and whether there was keyboard or mouse input. Screenshots are switched off by default and are only taken if the company expressly enables them; there is also a mode in which the screenshot is read on the employee's own machine and only the recognised text is sent.

From that data, an artificial intelligence model (Anthropic's Claude models) writes a single plain-language sentence per person per day. The hours worked, the breaks and that sentence are sent by email, and a table can be exported for a labour inspection.

Puntavia never collects:

  • keystrokes;
  • the contents of messages or documents;
  • the location of the device or of the person;
  • camera images or microphone audio;
  • personal files.

The product blocks nothing: it does not prevent access to applications or websites, it does not interrupt work, and it performs no action on the computer beyond the recording described above.

4. Hosting

The Services run on the infrastructure of the following providers:

  • Hetzner Online GmbH — server hosting in a data centre located in Finland (European Union);
  • Stripe Payments Europe, Limited — payment processing;
  • Resend — transactional email, delivered through Amazon SES in the European Union region;
  • Anthropic PBC (United States) — artificial intelligence analysis of the activity data in order to generate the daily sentence. Customer data is not used to train models.

Apart from the artificial intelligence analysis described above, the data held in the Services is stored and processed within the European Union.

5. Intellectual and industrial property

All content of the Services, including without limitation texts, graphics, images, icons, software, source code, design, navigation structure, databases and distinctive signs (in particular the "Puntavia" name and its figurative elements), is the property of Golova Europe SL or its licensors and is protected by Spanish, European and international intellectual and industrial property law.

Without the prior, express written authorisation of Golova Europe SL, the User is not entitled to reproduce, distribute, publicly communicate, transform, decompile or modify any of such content, in whole or in part, in any medium, except as permitted by law.

"Puntavia" is a trademark and trade name of Golova Europe SL. Other trademarks appearing in the Services, including those of the providers named in this Legal Notice, are the property of their respective owners and are used in accordance with applicable law.

The data that a customer company records through Puntavia remains its own. Golova Europe SL acquires no ownership rights over that data by hosting or processing it.

6. Conditions of use

The User undertakes to use the Services and their content in accordance with the law, this Legal Notice, public order, good practice and good faith. In particular, the User undertakes not to:

  • Use the Services in a manner contrary to Spanish, European or other applicable legislation, or in a manner that may harm the rights and interests of third parties;
  • Engage in conduct that may damage, disable, overload or deteriorate the Services or prevent their normal use by other Users;
  • Introduce or disseminate computer viruses, malware or any other harmful element;
  • Attempt to access the Services or other companies' accounts without authorisation, or interfere with their security measures;
  • Use the Services for unsolicited commercial communications or for any purpose contrary to the LSSI-CE or applicable consumer protection legislation.

The company that installs the desktop program on work computers decides what is recorded and for what purpose, and is responsible for doing so in accordance with applicable labour and data protection law, informing the affected employees and their representatives clearly and in advance. Golova Europe SL provides the functions described in section 3, including the option of keeping screenshots switched off, but does not replace the company in that duty to inform.

Installing the program on other people's computers, without the knowledge of their users or outside an employment relationship, is expressly prohibited and may lead to immediate suspension of the account.

7. Limitation of liability

Golova Europe SL provides the Services "as is" and uses reasonable efforts to ensure their proper functioning. To the extent permitted by applicable law, Golova Europe SL is not liable for:

  • Service interruptions caused by force majeure, telecommunications failures, attacks on the infrastructure or other circumstances beyond its reasonable control;
  • Damage arising from improper or unlawful use of the Services by the User or the customer company, including installation of the desktop program without informing the people affected;
  • Content made available by third parties through the Services or accessible via links to third-party websites;
  • Employment, disciplinary or pay decisions that the customer company takes on the basis of the information displayed by Puntavia.

The daily sentence is generated automatically by an artificial intelligence model from the recorded application names and window titles. It is an automatic summary and may contain errors or inaccuracies: it is not an assessment of an employee's performance and does not replace human verification of the recorded hours before they are used for employment purposes.

Nothing in this Legal Notice limits the User's rights as a consumer under Spanish, European or other applicable consumer protection law.

8. Links to third-party sites

The Services may contain links to websites or applications operated by third parties, in particular to the providers named in section 4. Golova Europe SL does not control the content, policies or operation of such third-party resources and is not liable for them.

The existence of a link does not imply endorsement of the linked site or its operator. The User accesses third-party resources at their own risk and is subject to the terms and privacy policies of those third parties.

9. Data protection and cookies

The processing of Users' personal data is governed by the Privacy Policy published at https://puntavia.com. Questions about data protection may be addressed to privacy@puntavia.com.

The use of cookies and similar technologies is governed by the Cookie Policy published on the same website. Puntavia uses no analytics cookies, no advertising cookies and no third-party trackers.

Everyone has the right to lodge a complaint with a supervisory authority. As Golova Europe SL is established in Spain, the lead supervisory authority is the Spanish Data Protection Agency (AEPD, www.aepd.es).

10. Amendments

Golova Europe SL reserves the right to modify, at any time, the configuration of the Services and the content of this Legal Notice, in particular in order to reflect changes in legislation or changes in how the product or its providers work.

The version in force is always available at https://puntavia.com and carries its date. Continued use of the Services after a modification constitutes acceptance of the new version.

11. Applicable law and jurisdiction

This Legal Notice is governed by Spanish law. Any dispute arising out of or in connection with the use of the Services shall be submitted to the courts and tribunals of Barcelona, Spain, without prejudice to the right of consumer Users to bring actions before the courts of their domicile or country of habitual residence (Articles 17 to 19 of Regulation (EU) 1215/2012, Brussels Ia).

In compliance with Regulation (EU) 524/2013 on online dispute resolution for consumer disputes, the European Commission's Online Dispute Resolution platform is available at https://ec.europa.eu/consumers/odr. The Company does not undertake to participate in any specific out-of-court dispute resolution system unless required by mandatory law.

12. Languages

This Legal Notice is published in Spanish and in English. The Spanish version is the reference version: in the event of any discrepancy between language versions, the Spanish version prevails.

The English version is provided for the convenience of users who do not read Spanish and creates no rights or obligations different from those of the Spanish version.
